font-size: 16px;"><span style="font-size: 16px;">事故发生后，赵某夫妇与张某、物业公司及其保险公司等就赔偿事宜进行了协商，但未能达成一致意见，故赵某夫妇将上述各方诉至武江法院，请求判令各被告连带赔偿130万元。</span></p><p>&nbsp;</p><p style="text-indent: 2em; font-size: 16px;"><span style="font-size: 16px;">法院经审理后认为，根据《中华人民共和国民法典》第一千二百四十五条规定：&ldquo;饲养的动物造成他人损害的，动物饲养人或者管理人应当承担侵权责任；但是，能够证明损害是因被侵权人故意或者重大过失造成的，可以不承担或者减轻责任。&rdquo;<span style="font-weight: bold;">张某作为乌龟的饲养人和所有人，应当对赵某小孩的死亡承担侵权责任。</span></span></p><p>&nbsp;</p><p style="text-indent: 2em; font-size: 16px;"><span style="font-size: 16px;">至于物业公司，根据《中华人民共和国民法典》第一千二百五十四条&ldquo;从建筑物中抛掷物品或者从建筑物上坠落的物品造成他人损害的，由侵权人依法承担侵权责任&hellip;&hellip;物业服务企业等建筑物管理人应当采取必要的安全保障措施防止前款规定情形的发生；未采取必要的安全保障措施的，应当依法承担未履行安全保障义务的侵权责任。&rdquo;的规定，只有在其&ldquo;未采取必要的安全保障措施&rdquo;的情况下，才需要承担相应责任。</span></p><p>&nbsp;</p><p style="text-indent: 2em; font-size: 16px;"><span style="font-size: 16px;">然而，赵某夫妇未能举证证明物业公司存在&ldquo;未采取必要的安全保障措施&rdquo;的情形，因此法院对赵某夫妇要求物业公司承担责任的主张不予支持。对于保险公司的责任，由于物业公司在本案中不承担责任，因此保险公司也无须承担赔偿责任。</span></p><p>&nbsp;</p><p style="text-indent: 2em;
