text-align: justify;"><span style="font-size: 16px;">新修订的《中华人民共和国治安管理处罚法》对此类违法行为进行了明确，首次将无人机“黑飞”行为明确列为妨害公共安全的行为并给予处罚。新法将于2026年1月1日起正式施行，这一修订标志着我国对民用无人驾驶航空器的管理进入全新阶段，为公共安全筑起一道坚实的“法律防火墙”。</span></p><p style="text-align: justify;"> </p><p style="text-indent: 1.88235em; text-align: justify;"><span style="font-size: 16px;">其中，新版《中华人民共和国治安管理处罚法》第四十六条规定：违反有关法律法规关于飞行空域管理规定，飞行民用无人驾驶航空器、航空运动器材，或者升放无人驾驶自由气球、系留气球等升空物体，情节较重的，处五日以上十日以下拘留。飞行、升放前款规定的物体非法穿越国（边）境的，处十日以上十五日以下拘留。新法明确将“违规飞行无人机”纳入妨害公共安全行为，处罚力度大幅升级。行为人具有以下情形将列为妨碍公共安全行为：在机场航线及邻近区域实施危害航空安全的；违法飞行民用无人驾驶航空器、航空运动器材升放无人驾驶升空物体，发生失控坠落，可能导致安全事故，危害地面安全的；多次实施的；其他具有妨害公共安全情形的行为，将被认定为“情节较重”。</span></p><p style="text-align: justify;"> </p><p style="text-indent: 1.88235em; text-align: justify;"><span style="font-size: 16px;">此外，已于2024年1月1日起发布的《无人驾驶航空器飞行管理暂行条例》第四十七条规定：违反本条例规定，民用无人驾驶航空器未经实名登记实施飞行活动的，由公安机关责令改正，可以处200元以下的 罚款；情节严重的，处2000元以上2万元以下的罚款。</span></p><p style="margin-bottom: 0px;
